
LAW NO. 6698 ON THE PROTECTION OF PERSONAL DATA (KVKK)
EMPLOYEE CANDIDATE INFORMATION AND CLARIFICATION NOTICE
Pursuant to Article 10 of the Law on the Protection of Personal Data ("KVKK"), the Communiqué on the Principles and Procedures to Be Followed in Fulfilling the Obligation to Inform, and the relevant legislation, we hereby inform you through this Clarification Notice, which has been prepared for job applicants applying through our website at www.montestrading.com. You may review our KVKK policies on our website.
1. DATA CONTROLLER
Your personal data are processed by Montes Foreign Trade Limited Company ("Data Controller/Montes") in its capacity as the "Data Controller" as defined under Article 3 of the Law No. 6698 on the Protection of Personal Data.
2. PURPOSES OF PROCESSING PERSONAL DATA
The personal data you provide through the application form available on the relevant website are processed for the following purposes:
Planning and execution of human resources processes;
Conducting recruitment, evaluation, and placement processes for employee candidates;
Assessing your suitability for the position you have applied for (Customer Representative, Sales & Marketing Specialist, Warehouse Supervisor, Accounting & Finance Specialist, etc.);
Contacting the individuals you have listed as references in your résumé and verifying the information provided;
Establishing necessary communication with you as a job applicant via telephone and/or e-mail;
Re-evaluating your application for future suitable job opportunities in the event that your current application is unsuccessful;
Ensuring compliance with applicable legislation and fulfilling evidentiary obligations in potential legal disputes.
Your personal data are processed within the scope of the personal data processing conditions and purposes specified in Articles 4, 5, and 6 of the Law.
3. PERSONAL DATA PROCESSED
Within the scope of the career application form on our website and the résumé (CV) file you upload, the following categories of personal data may be processed:
Identity Information
Your name and surname; and, if included in your résumé, your nationality, place and date of birth, photograph, and other identity details contained in official documents you voluntarily provide.
Contact Information
Your telephone number, e-mail address, and, if specified in your résumé, your residential or correspondence address.
Education, Professional Qualification, and Employment History Information
Information regarding the position applied for (Customer Representative, Sales & Marketing, Warehouse Supervisor, or Accounting & Finance), as well as educational background, school and graduation information, certificates, foreign language proficiency, computer skills, and details of previous work experience contained in your résumé.
Transaction Security Information
Website access records, internet log records, and IP address information automatically recorded during the completion of the application form.
Visual Records
Your photograph if voluntarily included in your résumé.
Personnel Information
Information contained in your CV, including educational background, diploma and certificate information, social security (SGK) records, employment start and termination information, spouse, children, family relationship information, identity and population registration details of family members, references, military service status, and salary expectations.
4. RECIPIENTS OF PERSONAL DATA AND PURPOSES OF TRANSFER
Within the scope of this Clarification Notice, your personal data may be transferred, limited to the purposes specified in Article 2, to:
Company representatives and shareholders for the purpose of conducting employee candidate selection and placement processes;
Our attorneys for the management of legal disputes;
Law enforcement agencies, judicial authorities, and other competent public institutions and organizations for the fulfillment of legal obligations and the establishment of evidence in legal disputes;
The Social Security Institution (SGK), the Turkish Employment Agency (İŞKUR), and other authorized public authorities for the fulfillment of obligations related to employment and occupational health and safety.
Such transfers shall be carried out where necessary and in accordance with the personal data processing conditions specified in Article 8 of the Law.
5. METHODS OF COLLECTING PERSONAL DATA AND LEGAL GROUNDS
Your personal data are collected and processed by our Human Resources Department and other relevant departments through:
Job application and evaluation forms;
Third-party employment and recruitment websites;
İŞKUR, private employment agencies, intermediary institutions and organizations;
Written application forms completed physically;
Interviews and reference checks;
Research conducted by our Company;
Remote access methods where necessary.
Such personal data are processed and collected in written or electronic form, through fully or partially automated means or by non-automated means provided that they form part of a data recording system.
Your personal data are retained for a period of one (1) year in accordance with our Personal Data Retention and Destruction Policy and the applicable legislation.
Your personal data are processed based on one or more of the following legal grounds specified in Article 5(2) of the Law:
Article 5/1: Obtaining the explicit consent of the data subject;
Article 5/2(c): Processing being necessary for the establishment or performance of a contract;
Article 5/2(ç): Processing being necessary for the fulfillment of a legal obligation of the Data Controller;
Article 5/2(d): The personal data having been made public by the data subject;
Article 5/2(e): Processing being necessary for the establishment, exercise, or protection of a legal right;
Article 5/2(f): Processing being necessary for the legitimate interests of the Data Controller, provided that such processing does not violate the fundamental rights and freedoms of the data subject.
With respect to special categories of personal data, including health data:
Article 6/3(a): Explicit consent of the data subject;
Article 6/3(f): Processing being necessary for the fulfillment of legal obligations in the fields of employment, occupational health and safety, social security, social services, and social assistance.
6. RIGHTS OF THE DATA SUBJECT (RIGHT OF APPLICATION)
Pursuant to Article 11 of the Law No. 6698 on the Protection of Personal Data regulating the rights of data subjects, you may submit your requests regarding your rights in accordance with Article 13/1 of the Law titled "Application to the Data Controller" and the Communiqué on the Principles and Procedures for Application to the Data Controller.
