In accordance with the Personal Data Protection Law No. 6698 ("KVKK/Law") and the relevant legislation, we attach great importance to the processing and protection of your personal data. In order to prevent the unlawful processing of personal data, prevent unlawful access to personal data, and ensure the protection and preservation of personal data, the necessary technical and administrative measures required under the applicable legislation are implemented.

Pursuant to Article 3 of the Law, natural persons whose personal data are processed are defined as the Data Subject, while any information relating to an identified or identifiable natural person is defined as Personal Data.

Pursuant to Article 10 of the Law and the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Obligation to Inform, we hereby inform you through this Privacy Notice, which has been prepared to cover individuals who receive products or services from us and those who visit our website. Your personal data are processed by Montes Foreign Trade Limited Company ("Data Controller/Montes"), acting in its capacity as the Data Controller as defined under Article 3 of the Personal Data Protection Law No. 6698 ("KVKK").

2.PURPOSES OF PROCESSING PERSONAL DATA:

Your personal data are processed for the purposes set out below in accordance with the principles stipulated under Articles 4 and 5 of the Personal Data Protection Law ("KVKK").

  • Carrying out the sales and marketing processes of petrochemical and polymer products (Polypropylene, Polyethylene, PVC, Polystyrene, Compound, Masterbatch and Additives, Packaging Products, etc.) as well as petrochemical equipment, machinery and spare parts,
  • Managing import operations carried out with global manufacturers and international trade supply processes,
  • Carrying out and monitoring national and international logistics, warehousing and distribution processes, including road, sea, air and rail transportation,
  • Developing and managing distributorships, solution partnerships and customer-specific flexible financial solutions/marketing strategies,
  • Providing customer relationship management, order, quotation and after-sales technical support services,

Identity Information (Your Name, Surname), Contact Information (E-mail Address, Telephone Number, and, where provided, Address Information), Legal Transaction Information (Personal information contained in correspondence with competent public institutions and organizations, including law enforcement authorities and judicial authorities, concerning individuals having a legal relationship with the Company), Customer Transaction Information (Product orders, requests for petrochemical products and machinery/equipment, quotation requests, and transaction information shared within the scope of financial processes), Professional Experience Information (Profession, position, title and company information, where provided via the internet or through the career page), Transaction Security Information (Website login and logout records, access and log records, cookie information, IP address information), product and service request information, and your personal data contained in the messages or files you share or upload through quotation forms are processed, stored and retained.

4.TO WHOM AND FOR WHAT PURPOSES YOUR PROCESSED PERSONAL DATA MAY BE TRANSFERRED:

Your personal data processed within the scope of this Privacy Notice may be transferred, solely for the purposes specified in Article 2, including product procurement, global marketing, sales processes, communication, management of logistics processes, and the fulfillment of requests and complaints, to our relevant department employees, company shareholders, suppliers with whom we cooperate in domestic and international logistics, customs clearance and warehousing processes, our financial solution partners, our global distributors and manufacturing partners, our attorneys where necessary to be used as evidence in possible legal disputes, and competent public institutions and organizations, including law enforcement authorities and judicial authorities, in accordance with the personal data processing conditions set forth in Article 8 of the Law and limited to the purposes specified therein.

5.METHODS OF COLLECTING PERSONAL DATA AND LEGAL GROUNDS:

Your personal data are automatically processed electronically when you visit our website, through cookies used as technical communication files, by completing the contact and product information forms available on our website, submitting your special order and quotation requests, and accessing the relevant sections of the website. For the purpose of fulfilling requests and complaints, your personal data processed within the scope of correspondence with competent public institutions and organizations, including law enforcement authorities and judicial authorities, in the event of possible legal disputes, are processed and collected by fully or partially automated means or by non-automated means provided that they form part of any data recording system.

Your personal data are processed and collected based on one or more of the conditions specified in Article 5, Paragraph 2 of the Law, as follows: where necessary, "obtaining explicit consent" pursuant to Article 5/1 of the Law for the use of consent-based cookies; pursuant to Article 5/2(a), where expressly provided for by law regarding identity, contact, legal transaction and transaction security data; pursuant to Article 5/2(c), where processing is necessary for the establishment or performance of contracts between our Company and the relevant persons or organizations, provided that such processing is directly related to the establishment or performance of the contract, including identity, contact, legal transaction and transaction security information of the contracting parties; pursuant to Article 5/2(ç), where processing is "necessary for the Data Controller to comply with its legal obligations"; and pursuant to Article 5/2(f), where processing is "necessary for the legitimate interests of the Data Controller, provided that such processing does not violate the fundamental rights and freedoms of the Data Subject", for the purpose of receiving product/service requests, communication and managing related processes.

6.RIGHTS OF THE PERSONAL DATA SUBJECT (RIGHT OF APPLICATION):

Pursuant to Article 11 of the Personal Data Protection Law No. 6698, which regulates the rights of the data subject, you may exercise your rights in accordance with Paragraph 1 of Article 13 of the Law titled "Application to the Data Controller" and the provisions of the Communiqué on the Procedures and Principles of Application to the Data Controller by completing the Data Subject Application Form available on our website and submitting it to Montes Foreign Trade Limited Company ("Data Controller/Montes"), at Halkalı Merkez Mah. Dereboyu Cad. Antplato No:4/157-158 Küçükçekmece / Istanbul, in person together with documents verifying your identity, by sending an e-mail from your registered electronic mail address in our systems to info@montestrading.com, by sending a Registered Electronic Mail (KEP) to montes@hs06.kep.tr, or through a Notary Public.

Requests submitted to our Company will be responded to in writing or electronically, depending on the nature of the request, as soon as possible and no later than thirty (30) days, subject to the processing fee specified in Article 7 of the Communiqué on the Procedures and Principles of Application to the Data Controller.
